M/s DataWind – non delivery of product, no refund

1. During June 2012, M/s DataWind had made an offer on their website www.ubislate.com, promising that they would deliver their product UBISLATE7+ by end of June 2012 against an advance payment of Rs.2999/- . 2. In response to this offer, I booked online one UBISLATE7+ on 10.06.2012 (booking ID “PM66B4C484”), for which I made an advance payment of Rs.2999/- vide Cheque No. 403505 dated 21.06.2012 drawn on Axis Bank. The cheque was sent to M/s DataWind vide Speed Post No. EP28594133IN dated 22.06.2012. Copies of the “Pre-Booking Confirmation Letter” and my payment forwarding letter are attached herewith for your ready reference. 3. M/s DataWind had promised that the product would be delivered by end of June 2012 but it has not been delivered till date. 4. In view of the abnormal delay in delivery of the product, I requested M/s DataWind by electronic mail on 23.10.2012 to refund my money. 5. However, there was no response from M/s DataWind. So, I again requested M/s DataWind on 05.11.12 to refund the amount. I received an email on 07.12.12 (i.e. after delay of more than a month) offering me a different product “Ubislate 7Ci”, that too at a higher price of Rs.3999/-. On 09.12.12, I declined this belated and costlier offer and again desired the refund of my money. 6. After this, M/s DataWind again went silent. 7. On 11.01.13, I once again requested M/s DataWind to refund my money or else I would have to seek legal remedy, but in vain. 8. Therefore, I served a notice to M/s DataWind cautioning them that I may file a complaint under the Consumer Protection Act, 1986 and that I may claim the damages against the loss of time, energy and agony suffered by me in this case. Copy of this notice sent to M/s Datawind vide India Post No. EP 212648036 IN dated 28.02.2013 is attached for ready reference. 9. In response to this notice, I got a phone call in April 2013 from an executive of M/s DataWind, who told me that the matter was being resolved. He requested me to wait for sometime. 10. However, on 10.07.13, an executive of M/s DataWind again telephoned me asking me to deposit some additional money in case I wanted the product. However, I declined to pay any more money. 11. Thus, despite all my requests, M/s DataWind have neither supplied the product within

M/s DataWind should return the money paid by me alongwith interest @18% per annum, and in addition also pay Rs. 1500/- towards compensation for aforesaid losses
