I booked a flat in Amrapali Zodiac Project Sec 120 Noida which was scheduled to handed over by March 12 with 3 month variation i.e. latest by July 12. The builder has given the possession intimation letter on 1st April’13 and asked for the payment of remaining amount within 30 days. I made the payment on 27th April’13. As per contractual agreement, I should get the possession within 30 days from the payment, i.e. by May’13, but I am able to get the possession by 15th Nov’13. i.e. after a delay of 6.5 month so I should get the penalty amount for the delay. While enquired, No response is received from the Amrapali. It is very clear indication that builder had given the possession intimation letter just to avoid penalty without actually completion of the work. And now avoiding payment of penalty amount. I also lodged the complaint with CREDAI vide no. 1213003226 dated 24th Dec’13 and 0114003254 dated 26th Jan’14, but I had not received any response on my complaint. I request your intervention in the matter.
want the compensation on account of delay in possession by Amrapali for 6.5 month delay as per contract term which is Rs. 10 per sqft totaling to Rs. 69875 ( 10*1075 ft*6.5)
