Uttar Pradesh Awas Vikas Parishad (UPAVP) allotted me a Flat at Hindon Enclave under SFS at Siddharth Vihar Yojna, Sector-7, Ghaziabad vide Demand Letter No.823 Dt.27.01.2014 on my online application no. 4600678. However the floor no. was not specified in Demand Note. Hindon apartment has total “S+18” floors. My family has two children & parents who are above 75 years & it is not recommendable for me to accommodate myself with family in upper floors of high rise. It was also evident that the Registration was made without lottery which means the response from public was very poor. Even self was allotted in general category despite of very heavy reservation. Poor response also indicated that the cost of flat is not commensurate with the salient features of the scheme which also demoralised the allottee. You may kindly appreciate that such a huge investment in a flat without knowing floor number is not judicious since the same can’t be disposed off incase of unsuitable floor due to poor demand. This was appraised to UPAVP vide my Letters Dt.12.02.2014. However UPAVP in their letter quoted that allotment of floor through lottery was stated in the advertisement. Then why the Demand letter was issued prior to conduct of lottery? The details of scheme was enquired from other sources after receipt of Demand Note. It came to fore that the Scheme is a failed project launched many times earlier also. The advertisement did not have mention of re launching of scheme several times due to poor response. However instead of reviewing the scheme, it seems that UPAVP re launches it by making provision of online application thereby trapping the innocent consumers either compelling to purchase a very costly flat or surrender a very huge amount as penalty. No transparency has been maintained regarding List of applicants of this scheme. It was expected that List of applicants will be published in official website of UPAVP under “Public Notices” menu (as has already been done for the other schemes) so that applicants may comprehend the demand of flats at a glance. There will be also Time gap of issuance of Demand Notice after publication of list so that applicants may have the option to withdraw their application. No option has been provided to the applicants to withdraw their applications before issuance of Demand Letter & Demand Letter was issued directly after applying for the scheme.. The above points were appraised to UPAVP vide my Letters Dt.12.02.2014,Dt.11.03.2014 & Dt. 11.04.14 & requested for surrender of the above flat..The replies given by UPAVP vide Letter No. 1636 Dt.04.03.2014 & No.2355 Dt.29.03.14 were unreasonable & unfounded. Finally UPAVP vide their Order no. 3636 Dt.23.04.14 intimated that a huge amount of Rs.54,954/- {20% + 3.09% of EMD amount of Rs.2,38,000/-) has been deducted.
