Bureau of Indian Standards – pension fixed by BIS has not considered the stipulation

I am a pre 2006 pensioner from Bureau of Indian Standards. I submitted my technical resignation in 1999 after 17 yrs of service to take up assignment in a PSU. I was in the PB 4 grade (Rs 14300-18300). The pension fixed by BIS has not considered the stipulation of Cl 4.2 of OM no 38/37/08-PPW(A) dt 1.09.2008 which stipulates that minimum payable pension shall not be less than 50% of the min of the pay in pay band plus grade pay corresponding to the pre revised pay for the proportionate years of service. The pension has been calculated only as per cl 4.1 and the minimum payable criteria has not been applied on account of recommendations of 6PC. My grievance submitted earlier has just been closed by refering the matter to the concerned department without any logical conclusion.
