Casabella Gold 3 – Refund of Booking Amount + 10% consideration amount

Please find the detailed information:- 1.Flat/Plot number: Europa “F” 1901 2.Project name: Casabella Gold 3.Location of the project: Dombivali (East), Thane 4.Cost of flat/plot: Rs. 46,82,880/- (Registration Charges Not included) 5.Payment made: a) Paid Rs. 45,000/- as Booking Amount vide Axis Bank Chq No. 195096 Dtd 16 Feb 2013 (Acknowledgement available) b) Paid Rs. 4,18,605 as towards 10% of Flat Cost vide Axis Bank Chq No. 360293 Dtd 07 Mar 2013 (Lodha Receipt No. 1700223594 dtd 08 Mar 13) c) Paid Rs. 14,362/- Vide Axis Bank Chq No. 360273 Dtd 17 Mar 2013. Total amount paid to Lodha Dwellers Pvt Ltd= Rs. 4,77,931/- 6.Cost of damage: Rs. 4,77,931/- 7.My postal address: 4/13, Vijay Vilas, Ghodbunder Road, Kavesar, Thane (W) 400 607 8.Nature of complaint and description:- I had booked the Flat on 16 Feb 2013 in the ongoing project of Lodha Dwellers Pvt Ltd. The possession is supposed to be in Aug 2014. At the time of booking the Sales Manager had promised that they will help and get the Housing Loan sanctioned. I was supposed to make payment of 10% of consideration value of the Flat within 20 days. However, I was reluctant as the loan process was not completed. The Relationship Manager made continuous follow up to receive 10% of consideration value. However, Mr. Amit – Loan Assistant from Lodha was in touch and assured that the sanction will be done. I made the payment of Rs. 4,18,605/- on 07 Mar 13. I also made a payment of Rs. 14,326/- on 17 Mar 13 as advised by Relationship Manager on 17 Mar 13. Mr. Amit from Lodha approached few Banks and told me that due to CIBIL issue the Housing Loan Sanction is somewhat problematic but kept on giving options. I also tried from few sources but in vein. In the meantime, the Relationship Manager kept on following up for payment of additional 10% and lining up for Registration. To which I resisted as the Housing Loan was not sanctioned and there was no point in fixing more amount with builder. However, Lodha Dwellers Pvt Ltd finally conveyed that the Booking is cancelled and the 10% of consideration value is forfeited as per Terms & Conditions. I am shocked to hear that as I have not done any registration or signed anything on Stamp Paper.
