Dear Sir \ Mam My builder elite homz is has delayed my possession & not updating on the possession date of: flat number 204, f -block, sector 77, 2nd floor, Noida: In spite the delay in project. The penalty terms in contract entitles me for a compensation of. 7500 rs per month .My allotment letter is dated 20 feb 2011 and terms and condition mentions 30 month plus 6 months grace period. Deadline with grace period date is also overdue for possession on 20 feb 2014; as per contract . I have been paying interest to bank & EMI as per contract & also rentals leaving me with no saving at all. All payments on my part have been cleared on time as & when intimated by them. The allotment in fact will take another 9 months. Please advise on the above to enable us proceeds further. I have been also charged penalties 18% interest rate (as per contract in one of the delays) . Now when it come to them, for paying for penalties they have stopped communicating anywhere in writing. However verbal communication only indicates that if we take this matter to legal authorities, it will not solve rather complicate the issue. Whenever asked for any support document from Noida authorities in area, clearance, parking facilities, noc , building progress etc They also revised the area at their will & increased our payment structure. With no legal communication & added in revised agreement later than initial booking area confirmed.

I would need only 2.5 lakhs or comensatory amount justified for loss as above that law thinks is right .
