We have purchased APC Inverter with battery from Yashas Power Systems, 347, 5th Main, 3rd Phase, Manjunath Nagar, Bangalore vide receipt No. 235 dt 26th July 2008. The battery supplied by the dealer Yashas Power Systems, was TATA Green Battery of TATA Auto Comp GY Batteries Pvt Ltd which failed about 15 months after the purchase, ie within the free replacement warranty period of 18 months as per the warranty card of the battery.
Initially repeated phone calls to the dealer/supplier Yashas Power Systems, did not elicit any response. Ultimately after sending a couple of e-mails the company responded to our phone calls. Thereafter, after a gap of about 20 days the company on 19th Jan 2010 collected the defective battery. Thereafter the supplier company Yashas Power Systems, called us and informed us that they would replace with a new battery if we are willing to foot 40% of the cost of the battery. When we threatened to go to consumer court, they assured that a new battery would be supplied free of cost and it would take some time. They did not care to provide a substitute battery despite our repeated requests. Again after pursuing several times and several days after my sending another e-mail to take the company to consumer court and also claim damages for not supplying the substitute battery, the supplier ultimately after a lapse of one month from the date of taking the defective battery, supplied a defective substitute battery which gives a back up for hardly 30 minutes. Thus the supplier company Yashas Power Systems and the battery company TATA Auto Comp GY Batteries Pvt Ltd. did not care to comply with their warranty commitment and provide a new battery free of cost and hence have breached Consumer laws. They have absolutely no regard for the consumers. Even as on date there are no signs of their willingness to provide a new battery as per warranty.
