Gati Courier – Mishandling of Booked items

Legal Notice sent to GATI Gati-Kintetsu Express Private Ltd 64, S. K. Dev Road, lake Town Kolkata- 700048 Sub: Claim against damage and breakage of consignment/docket no. 40025604 of Gati-Kwe, booked by Mr. Dhananjay Tiwari from 403, Amlesh Apartment, Malviya Nagar, Nagpur to 1st Floor, Jeet Jasmine, Nayabad, Kolkata-700094 Dear Sir(s)/Madam, Under instruction for and behalf of my client Mr. Dhananjay Tiwari, residing at B-3B, Eden Residency, Nayabad, Kolkata (previously resident of 403, Amlesh Apartment, Malviya Nagar, Nagpur) I write to you as under: 1. That my client, believing Gati –Kwe to be the best courier (movers and packers) of the country got in touch with your Nagpur office in mid of April’ 2013 for sending his household goods/items to Kolkata and was in tern contacted by your Mr. Santosh Kumar on 15-04-2013, who represented himself as supervisor of your company and posted at your Nagpur Office. 2. That believing Mr. Santosh’s representations to be true and the brand and reputation of your company, my client asked him the same day to have inspection of the goods, which were to be sent to Kolkata and extend a quotation. 3. That your Mr. Santosh gave a quotation of Rs. 27,000/- for safe packing and moving the goods from the abovementioned address at Nagpur to Kolkata and my client agreed to pay the quoted amount without any negotiation. 4. That on 18-04-2013 Mr. Santosh came to my client’s residence for packing the goods and started packing. My client being concerned of the safe transport of his valuable items asked him repeatedly that, if any additional insurance is required, he can pay for it. But my client was was assured that the goods will be delivered at the abovementioned destination at Kolkata quite safely and well in time. My client was also told by Mr. Santosh that the goods are always covered under transit insurance and there is nothing to worry. 5. All the 65 packets were booked with docket no 40025064 and the loaded truck of with the booked items/goods were to leave Nagpur on 20-04-2013 and the expected arrival of the goods at Kolkata was on 25th/ 26th of April, 2013. Photocopy of the Docket Pick-Up Slip with booking date 19-04-2013 is enclosed herewith and marked as Annexure-1. 6. That while packing the goods Mr. Santosh asked my client to sign a declaration regarding lumpsum value of the goods being despatched and my client signed the declaration in the format provided by Mr Santosh with an amount of Rs. 1,50,000/- (Rupees One Lac Fifty Thousand) only. However, the goods were of a much higher value. Photocopy of the said declaration is enclosed herewith and marked as Annexure-2. 7. That my client paid the agreed charges of Rs. 27,000/- (Twenty Seven Thousand) only in cash to Mr. Santosh. And after receiving the amount to utter surprise of my client Mr. Santosh issued 2 receipts one in the name of Global Packers & Movers for an amount of Rs. 18,000/- (Rupees Eighteen Thousand) only a

As this a matter is more than 3 months older. i have already sent legal notice, I now want full declared value (Amount) to be paid back to me by GATI as compensation.
