HPCL – Rate to be charged for supply of refill household gas cylinder

Respected Sir, With due respect, I would like to submit the following comments for your kind perusal and guidance please. I am a registered consumer (No. 618853) with M/s Dhar & Sons (Dealer of HP Gas), 203, Rashbehari Avenue, Kolkata-700019 for receiving supply of household HP Gas cylinder. I booked for a refill gas cylinder (un-subsidized) vides Booking No. 249338 dated 07/12/2013. The agency could send the refill cylinder on 03/01/2014 i.e. 27 days after date of booking and claimed a rate which was enhanced with effect from 01/01/2014. Being faced by the question “at which rate {i.e. (i) the rate existing on the date of booking of refill cylinder OR (ii) the rate existing on the date of delivery}, I am supposed to pay for such delayed supply by the agency”, I raised the issue with the HPCL through online consumer compliant portal on 03/011/2014 and being not satisfied with the reply, I again submitted it for reconsideration on 06/01/2014. Next day, an officer from HPCL talked to me on the matter over phone and finally I was given to understand that the rate as existed on the date of delivery for such cylinder was required to be paid and the rate as existed on the date of booking for cylinder had no relevance. However, I do not find the practice quite convincing as it may open up scope for wrong practices whereby certain section of consumers (for no faults on its side) ends up to pay enhanced rate of supply of such cylinder on account of delay in supply by the agency. As such I have tried to find the answer from acts and rules regulating such matter but have not find any distinct guidance on applicability of rate OR time schedule for delivery by agency after booking. Since, I did not receive any written confirmation on above deliberation through consumer complaint portal of HPCL, I thought it prudent to approach you for necessary guidance in this matter so that I could avail the services in appropriate manner. I wish to be aware as to which rate I should accept the delivery i.e. rate of refill gas cylinder as existed on the date of booking OR as existed on the date of actual delivery. It would also be of great help to know if there is any standing time schedule to be followed by gas agency to supply the cylinder after its booking.
