Mahindra First Choice – Misrepresentation Cheating

I had purchased a Volkswagen Jetta with the registration number HR 26 BR 8472 (2012 model) in December, 2014 (less than 5 months ago). The car was certified by Mahindra First Choice and all parts were represented to be in a good working condition. During the time of inspection and even though it was December (winter), I had asked your sales representative (Rohit: Phone no.783839xxx) to check the AC since it was not working properly. Your Sales Representative (who is Mahindra First Choice’s agent for all practical purposes) confirmed to me that he had got the AC checked and it was in perfect working condition. He also confirmed that as per Mahindra’s policy, any car that is bought from Mahindra First Choice is in warranty cover for one year and if any issue comes up later, the same would be taken care by Mahindra First Choice hassle free. Being satisfied with other details of the car, we purchased the car and it was working fine until now. After the advent of summer, i.e since March 2015, one we started to use the AC, we realized that it wasn’t working properly and I spoke to Rohit and informed him about the same. Rohit, informed me that the first servicing was pending and once the servicing was done by Mahindra First Choice, this problem would be resolved. Accordingly, I had submitted the car for servicing with Mahindrra First Choice where the service agent informed me that the gas for AC was not full and that is why the cooling was not proper. We insisted on getting the AC checked from Volkswagen Authorized Service Centre and to our shock, the Volkswagen Team has confirmed that the compressor of AC is not working and that is why the cooling has not been proper since we purchased the car. This fact has been concealed by Mahindra First Choice and all its Sales Representatives so that they are able to sell the car. Volkswagen Authorized Service Center has confirmed that the cost for replacement of the compressor would be in excess of Rs. 90,000/- (Rupees eighty thousand only) which is wholly attributable to be paid by Mahindra First Choice only because of the cheating and misrepresentation done by its sales agent and manager at the time of purchase of the car.

Rs.80,000 (towards repair of AC compressor) + penalty for cheating and harassment
