Malicious & Unfair Dealings by M/s DLF Ltd

M/s DLF had launched for sale its residential project – DLF Capital Greens in the year 2008 @ Rs. 6000/- per sq feet. They had offered to extend a Timely payment rebate of Rs. 500/- per sq ft to customers/buyers who paid up the money in time- they also promised to deliver the project in 3 years as per their Construction linked payment plan(CLP). Their project has been inordinately delayed & they never stuck to their construction schedule or demanded money as per schedule given in their CLP – the undersigned missed their timely payemnts on 2 occassions due to unavoidable circumstances/late receipt of demand notice from DLF – now DLF says they will deny the complainant of the benefit of Rs. 500/- per sq ft discount .

Rs.7,10,000 loss has been cuased to me due to denial by M/s DLF of extending benefit of Timely payment rebate of Rs. 500 per sq ft. Due to the inordinate delay in construction /handover of the residential property , I wanted to sell the property & all rights thereon , whereby They maintain that ” THEY MAY EXTEND THIS BENEFIT to me AT TIME OF FINAL PAYMENT ( at their discretion) BUT DENY THIS BENEFIT TO ANY TRANSFEREE OF THE SAID PROPERTY ”

1.Direct the respondent company to allow the transfer of the apartment bearing no.CGB086 along with the TRP benefit of Rs. 710000/- (Rupees Seven Lac ten thousand). And, 2. Pass an order to cancel the letter of undertaking forciby taken from me wherein the complainant was compelled to give an undertaking stating complainant is not entitled to TRP benefit provided by the respondent company. And, 3. Direct the respondent company to compensate the complainant with litigation expenses of this complaint. And, 4. Any other order as this Hon’ble forum may deem fit and proper.
