I purchased some services from Monster India in the month of Nov 2014 @69660/= per annum payable in quarterly installment with verbal consideration that if we do not with the service, we will stop the service and will pay as per usage at that point of time. The Agreed Services was 1. 15000 resume download per month in excel form 2. 15000 resume download per month in word/pdf form 3. 25000 bulk email perm month and 4. 100 jobs posting on monster.com I paid 17,416 at in advance for first quarter services. When I started using the services, I cam to know the service is not as per our need and it was wrongly presented to me by the sales executive Mr. Zaheer Quadri ( Monster.com). It was not as per our business need and it was over sold. I could not use it even 20% of the features. Going forward I decided to not to use the services as that was not as per our need and it was not appropriate product for our business. I shared my view that we are the services is not up to our requirement and they were not accepting this fact. Then I said I am not in position to use your service due to bad business condition. They were not ready to listen any thing from me and they are asking me to pay for entire year where as services was blocked after 4th months. I am requesting them to raise the invoice for what I have used. I willing to pay for the services I already consumed ( On pro rate basis) but no, they are forcing me use that service which is of no use for me. It is totally wrong product sold me by misguiding me. I have done so many mail communication. I requesting them for fair billing as per our uses but they are saying no, they are forcing to pay the whole amount. Means against their 4 months service they are demanding 12 months price. They ready to extend the contact period but they are not ready to terminate the contract. Now, its greate challange for me, if the service sold is not as per our need. If we are not using that mauch database, if my business never uses that much of bulk emails. why shoudl I pay ? I do not know much about legal stuff but they are sending me legal notice and asking to present on Hyderabad. How it is possible ? they are mentally torturing me and harassing me in every possible way. Please help.

1. I wish to pay as per my usage ( on pro rate basis). For example, if they have sold one and half lakh of resume download and i have used 25 thousand only, we should be charged for that only. 2. Second pay around is if our service Subscription was for 365 days and actively allowed to use it only 100 days, I should be charged for 100 days only. I am open for genuie service charges what i have used. But they are forcing me to use service which is of no use for me and I am not in position to accpet that forcibly even my requirement is not like that.
