I was looking for online dealers in bird feeders. I came across an advertisement on OLX.com dated 05.10.2013.I contacted on the phone no. given in the advertisement (+919819597645) on 28.10.2013. On the basis of my conversation with Mr. Gudhate, I placed an order for bird feeders. The dealer told me that the goods would be sent by courier. As per the text message received on 28.10.2013, I made the full payment of Rs. 2300/- including courier charges in advance towards the order by bank deposit (ICICI Bank a/c no. 008801019353, Dombivali Branch) on 29.10.2013. I called the dealer on the same evening to confirm the receipt of the payment. Since there was no information from the dealer, I called him again on 31.10.2013 and he told me that the courier was sent through Professional Courier Service and I should be getting it in a day or two. I asked for the tracking no. which he said he would send it to me. After the above conversation, there is absolutely no communication from the dealer. I did not get the goods till date. I called the dealer several times but there was no response. I didn’t have his e-mail id so I sent him a mail through OLX.com. But there was no response whatsoever. Finally, I sent Mr. Gudhate a notice on 02.12.2013 and asking him to refund my money. He responded by sending me an sms saying that he would deposit the money in my bank a/c/. I sent him my bank a/c no. After that he asked me for 10 days time. He has neither given me refund nor has communicated anything till date.

I want to get refund of the money I have paid to Mr. Sameer Gudhate + the money towards expenses. Mr. Gudhate owes me total Rs.2400/-i.e 2300/- payment towards the goods ordered + Rs.100/- towards expenses. I want Mr. Gudhate should pay me the above amount
