MR.YOGEN N VAID PROP.MOBILE ACCESSORIES LISIED ON EBAY AND DOING THE BUSINESS OF ONLINE MARKETING OF MOBILES BY GIVING ONE YEAR WARRANTY OF PRODUCTS WITH PICK UP AND DELIVERY FREE OF COST.

I RECEIVED THE ITEM THROUGH BLUE DART COURIER IN PACKED PARCEL. ON OPENING OF PARCEL I FIND THE MOBILE ALONG WITH USER MANNUAL OF EVO4.THEREAFTER I CONTACTED WITH THE SELLER BY EMAL THAT THE TOUCH SCREEN IS VERY HARD AND NOT WORKING PROPERLY AND ALSO YOU HAVE NOT SENT USER GUIDE FOR THE ITEM IN ORDER TO UNDERSTAND PROPER FUNCTIONING OF MOBILE. IN RESPONSE TO MY MAIL,THE SELLER SENT REPLY BY EMAIL THAT AGAIN AND AGAIN TRY BY PRESSING THE TOUCH SCREEN OF MOBILE AND THE USER MANNUAL DOES NOT COMES WITH THIS ITEM.BUT WE SHALL ARRANGE FOR YOU.

WHEN AGAIN I ASKED ABOUT THE PROBLEM,THE SELLER ASKED ME FOR PICKING OF THE PRODUCT.

I CONTACTED WITH CUSTOMER CARE EBAY ABOUT THE SELLER INTENTION.THEY ADVISED ME TO GET CONFIRMATION FOR REFUND OF MONEY.ON GETTING UNRESPONSIVE REPLY FROM THE SELLER THAT REFUND IS NO POSSIBLE, I OPENED CASE WITH EBAY RESOLUTION CENTRE AND ON 23-02-2011 I SUBMITTED THE CASE TO EBAY SECURITY CENTRE.

FURTHER I CONTACTED WITH EBAY RESOLUTION CENTRE FOR REFUND OF MONEY.THEY INTIMATED THAT FIRSTLY SEND THE MOBILE TO THE SELLER WITHIN THREE DAYS AND COPY OF RECEPIT TO US.THERAFTER ON CONFIRMATION FROM SELLER WE SHALL REFUND THE MONEY WITHOT ANY TIME FRAME.

SINCE AT THAT TIME I WAS OUT OF STATION AND REQUESTED FOR SENDING OF ITEM WITHIN SEVEN DAYS. BUT I DID NOT GOT ANY RESPONSE FROM EBAY.

IN SEPTEMBER I ONCE AGAIN CONTACTED WITH WITH THE SELLER FOR REPLACEMENT,/REPAIR OF THE ITEM SINCE IT IS IN WARRANTY PERIOD AND THE SELLER HAS ASKED ME TO SEND THE ITEM THROUGH BLUE DART COURIE SERVICES.THE SELLER ON 5-10-2011 ASKED THE BLUE DART COURIE SERVICES TO PICK UP THE ITEM AND THEY PICKED UP THE SAME.

THEREAFTER THE SELLER HAS INFORMED THAT THE ITEM CANNOT BR REPLACED AND IF YOU WANNTS TO REPAIR YOU HAVE TO MAKE PAYMENT IF REPAIR IS POSSIBLE. I CANNOT GURANTEE FOR RE OF THE REPAIR AND INSTEAD OF ANY SOLUTION STRAIGHT FORWARD INTIMATED RETURNING BACK THE ITEM TO ME. TILL DATE THE ITEM IS LYING WITH THE SELLER .

I THEREFORE REQUEST TO YOU TO KINDLY TAKE ACTION FOR VIOLATION OF AGREEMENT DONE BY THE SELLER AT THE TIME OF SELLING OF THE ITEM , DELISTING OF THE SELLER LISITED ON EBAY AND REPLACEMENT/REPAIR OF THE MOBILE.
