Opposite Party May it please your honours: This complaint petition is being filed on behalf of Mr. Parvinder Malik, VPO. Rojhla Tehsil Safidon Distt. Jind, referred hereafter as Complainant, and is as follows : 1.0 That this complaint Petition is being filed under Sec. 2 (1)(b)(i) of the Consumer Protection Act. 2.0 That the opposite party Samsung India Electronics Private Limited is engaged in the business of manufacturing and selling through its dealers Consumer Electronics like Laptop, Mobile, refrigerator, TV etc. to the public for a consideration, apart from other activities. 3.1 That on 18 September 2013, the complainant purchased a Samsung laptop model no. 350v5c-s07 serial no. hwdz98fcbd2q76 manufactured by O.P. from the Dealer of O.P., for a consideration of Rs. 43,000.00 paid in cash vide Cash memo No1332, a photocopy of the said document is furnished at Annexure – I. 3.2 That the computer purchased on dated 18th September 2013 but it bears a manufacturing date November 2012. It means that the computer was in store for almost one year. Probably was on display at store. It has outdated softwares. Low battery backup than the claimed. 3.3 The computer had a problem of BIOS which the Complainant discovered two days later after purchasing. Immediately the Complainant report the issue to the dealer as well as the Samsung customer service support centre. The Complainant asked them to replace the machine since it was defected prior to purchase. The Samsung customer service support centre said dealer will replace this machine; dealer said Samsung will replace it. 3.4 Since the first day of purchasing the computer frequently kept Crashing. BSOD problem. Initially the Complainant thought it a temporary software problem but it was discovered it was due to some conflicting hardware. 3.5 That the Complainant request the Samsung customer service support center to arrange a visit of engineer, which they agreed and told the Complainant that an engineer will be visiting him within 48hrs. but the engineer never came. 3.6 That the Complainant kept bearing for two months this dysfunctional machine meanwhile the Complainant contacted several times the Samsung customer service support center for remedial actions. Until November 19 when the machine stopped functioning completely. the Complainant lodged another complaint to the Samsung customer service support center on 21th November they gave him the re

PRAYER In view of the submissions contained in the preceding paragraphs, the complainant most respectfully prays to the Hon’ble Forum to direct the Opposite Party to: 1. Replace the computer with new one, or Return the price with interest @ 12% per annum and 2. Pay compensation In the sum of Rs 5,77,500/- (@ 1,10,000 per month for 5 months 3 weeks – from 18 September 2013 to 11 March 2014 ) towards the physical strain and mental agony suffered by the complainant. (Since the complainant is still incurring loss, The amount of compensation is compoundable.); and 3. pay a sum of Rs. 15,000/- towards cost of this petition and case; for which act of kindness, the complainant shall, as is duty bound, ever pray.
