I purchased a Blackberry mobile phone (model: 9810, black) from an online shopping website (www.ShopClues.com) and made an advance online payment of INR 15,949. Although I paid the money for a new mobile phone, I realised that the handset that was delivered to me on Saturday, 28 December 2013 was not a new unit. I could see scratches on the top of the phone and dust accumulated in the keypad. The phone also did not read a sim card. It did not receive signal. The earphones that came in the package were not manufactured by blackberry and were of some cheap quality. I paid money for a brand new product and I have been clearly cheated with a used and damaged product.I filed a request for the return of the product and refund of my money the next working day itself, (i.e.Monday, 30 December 2014). I kept sending them emails asking for a resolution but they never did anything concrete. Most of the times,they would reply by an automated computer generated email, saying they will get back to me in 3-4 business days but they did nothing about it. After I kept chasing them through emails and phones for close to a month, a guy named Suraj Chaudhary (mobile no. 09911909070)from the merchant shop(SLS Enterprises, K2/810, Mahipalpur, Delhi, 110037) called me and sent an executive to take the mobile phone back saying that they would replace the damaged mobile with a new mobile. The executive stamped the bill and wrote in his own hand “Received” as an evidence that I have returned them the defective mobile. Next, Suraj said that they do not have another fresh unit of the phone in their stocks and so I will have to wait for a couple of days for a new phone or else they would refund my money. After they took the phone from me, I tried calling them several times but they did not pick up my phone. Suraj Chaudhary deliberately stopped picking up my calls and never responded to my messages. In the end, after 45 days of this episode, I received an email fom ShopClues.com saying that according to the merchant, I had damaged the sim slot of mobile phone after it was delivered to me which is why the phone is not receiving signal. They shifted the entire blame on me and never discussed about the scratches on the phone, the dust inside the keypad and the duplicate earphones. I want all my money refunded and additional appropriate monetary compensation for the Mental Harassment that I have faced at the hands of these people. Also, I want SLS enterprises (the merchant) appropriately fined and prosecuted under IPC Sec.420 for cheating and fraud as he cheated me by taking full money in advance and then delivered a fake and damaged product.
