Timtara Fraud – Samsung Galaxy Note 2 Not Received

I ordered a Samsung Galaxy Note 2 mobile phone online at timtara.com. I paid an amount of Rs. 35,290 by using my SBI debit card on November 1, 2012. The details of the transaction are below. Order ID: 10346868 Transaction ID: 10152129 Order Date: 01st Nov 2012 02:01 pm Payment Mode: Net Banking Product: Samsung Galaxy Note 2 N7100 Mobile Phone(2 N7100) Price: Rs. 35,290 The order above was supposed to be shipped within a MAXIMUM of 3 weeks. It has been more 9 weeks since the order has been placed and I am yet to receive the product. I repeatedly requested the customer care to cancel my order after the 3 week duration expired and requested a refund of my amount. Every time I call I receive the same response that the issue will be resolved in 2 days. The issue is yet to be resolved.

After spending more than 3 weeks waiting for the phone, I went ahead and bought a new phone. Since then, I have been requesting for a refund of the amount I paid, Rs. 35,290 almost every day. This led a significant wastage of my time and effort. I spent over 40 hours on calls and emails with customer care. I could have spent this time on productive work earning income not to mention the loss of the work due to lack of a phone and significant frustration due to this whole process.

Refund of amount paid: Rs. 35,290 Damages due to wastage of effort/opportunity cost: Rs. 20,000 Any court/legal fee in the event of a legal action required I request you to help me get a refund of the amount paid and compensation for the time and effort spent during this process.
