The undersigned booked two N.A. Plots B-38 & B-39 each admeasuring 3003 sq. ft. respectively in your “Wari Woods” project on 13th Feb’2010 on payment of Rs.51,000/- (Rupees Fifty One Thousand Only) by cheque no. 102485 dated. 13.02.2010 of New India Cooperative Bank for a total consideration of Rs. 10,54,053/- (Rs. Ten Lakhs Fifty Four Thousand Fifty Three Only) each. Attached hereto is the copy of the receipt as Annexure- A for your reference. At the time of sale / booking of the said plots it was assured to us by the than Sales Executive Mr. Vivek that by end of March 2010 or end April 2010 the Eiffel will complete the process of signing the Sale Deed and the transfer the name in the extract of 7/12 will take place and the plotting will be completed by then. Beside this he further assured us that the most of the development work like water pipeline, internal road, club house work, electricity etc work will be start by end of 2010 as the same is in full swing. Basis the assurance believing the submission made by your employee and without verifying the status of above mentioned development work, we have made the first installment of Rs. 3,43,296/- (Rupees Three Lakh Forty Three Thousand two hundred ninety six only) for each plot. i.e. No. 39 & 38 total amounting to Rs. 6,86,592/- (Rupees Six Lakhs Eighty Six Thousand Five Hundred Ninety Two Only) by cheque no. 102499 of New India Cooperative Bank on 2nd April 2010 as required. Attached hereto to is copy of the receipt of such payment as Annexure – B for your ready reference. After this payment self and my wife visited your project site somewhere in August’2010 and were quite shocked and surprised to see the progress of the site. There was no progress and development as it was explained / assured to us. I tried calling the person concern but learnt that he left the organization and no more working. Tried calling your office & left the message to call me back with the details. Every time it was a different person starting from Anil Singh, Anupama, & Pradeep. However, no one was in a position to give us the concrete picture as to by when the project will be completed and by when we can sign and execute the “Sale Deed”. Looking at the uncertainty of the project, we decided not to make any further payment till we receive the clarity and confirmation in writing. Finally somewhere in April 2011 Mr. Priyesh contacted for the payment of the balance amount without the confirmation & clarity on the above developmental points. In a joint meeting with Mr. Rajeev and Priyesh, they explained that some developmental work has taken place. I therefore, request you to please send us the complete developmental plan of the project along with the targeted month of completion to ascertain the return on our investment and to plan the cash flows. The huge gap has disturbed our financial planning and therefore, you need to provide us some time to make the payment which will be subject to the development
They should pay back the entire money so paid as advance and interest there upon @ 18%.
