n the month of May-2012, Company Marketting Man Mr Devesh Srivastav visited at my Home & suggested investing money in Earth Studios in Greater Noida. Mr. Srivastav explained that an agreement will be signed in which it will be clearly described that the Flat handed over just after 4 years & till then, 12% return on your deposit, company will be paid with the Bank Guarantee. In the month of June-2012, the undersigned has booked two Earth Studio Flats 495 Sq.f at a negotiated price of Rs. 3950/- per Sq.feet & I have issued two Cheques No.180181 dated 12.06.2012 and 180185 dated 23.06.2012 amounting Rs. 2,00,000 (Rs. Two Lakhs) each of PNB total Rs. Four Lakhs as booking amount. These cheques were cleared & amount transfer in Earth Infra account No.1988002100189658 on 04.07.2012. After passing two month time, I contacted Mr. Devesh Srivastav on Mobile Phone No.8382005XXX, then Mr Srivastav informed me that he is no more in the service of Earth Infra & give me Mobile No. 8400041XXX of Mr.Deepak Dureja. I have contacted Mr. Dureja & explained the entire event but he has not cared to get personal contact even the application form & agreement. When I called him, he always pressurized to me to deposited remaining payment without any paper work & agreement. I have so many times contacted customer care but they always said, “you will be informed within a week.” Looking at the lack of professionalism and laid back attitude on the investments, I decided to withdraw the investment from company & in the month of June-2013. I have submitted refund papers by way speed post but Earth Infra denied for receiving such papers. Email against T.No.1143, I have received a reply as “We have two booking of yours Earth Titanium ETTS-239 and ETTS-360 as per our records. We have not received any such request till date on 28.12.2013.” I have again sent a postal certificate that such Speed Post has already been received in Earth office on 22.06.2013. While after receiving my refund papers though he denied, I have received SMS & letters from Earth Infra for depositing remaining payment without any further action like legal paper, agreement, Bank Guarantee and M/s Earth Infra cancelled my booking vide letter dated 29.10.2013. In the month March-2014, M/s Earth Infra returned my refund papers with some objections. After clearing objection, all papers relating to refund as per their proforma, I have been deposited in Earth Infra Lucknow office on 05.04.2014 & received duly acknowledgment from Ms. Parveen in presence of Mr. Amit Tiwari & they assured me that you will get your refund cheques within 15 days. Since then, I am dogdly following & continuous in touch by way of Email & phones but there is no result. I am a retired Railway Employee & this matter going to over almost two years, my principle amount refund back along with 12% interest because M/s Earth Infra are wrongly holding back my payments on one excuse or other.
I want my deposit money of Rs. 4,00,000/- (Four Lakhs) with 12% interest.
