1)2 year delay in flat possession 2)Lots of lies in ads, brochures, literature, responses 3)Substandard material, construction, service,response, maintenance, lifts, security, vital equipment handling 4)Almost new vehicle meddled, dragged, fallen down, damaged 5)Toilet RCC roof leaking dirty water since 020613, 111days, within 1 month of occupation 6)112 digital photos detailing defects/deficiencies in our 1 BHK flat sent — improper walls, plastering, grills, doors, windows, electrical & sanitary fittings, damaged tiles, etc 7)Half of promised Phase I amenities missing 8)Prevented from using terrace 9)Erratic RO water 10)Criminal waste of power, water, diesel 11)Flats left open, Flat keys left / handled carelessly 12)Selling used flats 13)Phase 1 construction to have been completed by June 2011, still on even now after 3 1/2 years from March 2010 14)Severe noise & dust pollution early morning to late night 15)No I’d cards/Passes for direct/indirect staff/contractors/visitors/vendors/etc 16)Power/Lifts/Common lights/ RO water operated as per their whims & fancies 17)Goondas, Rowdies, Gangsters, Unauthorised people roam & stay freely anytime / anywhere & even stay in empty flats 18)Zero/Arrogant/Improper/Inconsistent/Lying responses 19)Compelled Solar Water Heater & Piped Gas 20)Rs.51,501 final dues made Rs.1,61,000 & then waived under tremendous protest & pressure 21)Saleable area of 589 sqft revised to 710 sqft after booking & full payment in March & May 2010! Refused to pay the difference & refused as favour too! 22)We have communicated politely, hard-tough ways, nastily too over this tortuous 3 1/2 years 23)Internally managed & driven 24/7 Harassment & Threats with dire consequences, filthy/lewd comments from Day 1 24)150+mails/600+ digital photos as evidence on various serious problems/20+sms’s/many tel calls/talks/etc 25)Main door defaced 26)Wholesale badmouthing & abuses by direct&indirect staff, security / lift tech / electrical / gardening / paving staff is impossible without internal blessings / involvement 27)Police complaint given
1)Interest @ 12.5% p.a. on total amount paid, for delay from the date possession was committed while booking till actual possession date 2)Interest @ 12.5% p.a. for payments made in advance for the period by which paid in advance vis-à-vis the payment due date 3)Rs.300 per day of Toilet RCC Roof leak from 020613 till date of full rectification & Observation period of 2 weeks thereafter 4)Rs.10,000/00 or as per actual bill for repair/spares/body parts replacement/painting for vehicle damaged by their staff 5)Refund of Rs.250 per Saleable area sqft for 50% less amenities or Immediate provision of same 6)Interest @ 12.5% p.a. for Solar Water Heater & Piped Gas amounts collected before possession 7)No.maintenance charges till all basics like lifts/RO water/power/common lights & all promised amenities are up & running properly 8)Certification by at least 3 Government & 3 Private Civil Engineering Experts or a panel of experts drawn from Credai/Cmda/Dtcp/3 reputed private civil engineering consultants totally unconnected with builder / promoter in any way on life expectancy of flat / buildings in this complex 9)If life certified is less than 50 years, builder should give written undertaking with adequate Bank guarantees/Indemnity bonds/relevant financial instruments that they will.make good the loss or build certified quality flats / buildings / complex if destroyed / dilapidated in less than 50 years especially since they claim construction as per Seismic zone III standard 10)Adequate compensation for the tremendous defamation 11)Items at serial no.s 1,2,5,6,7,9 sought & requested above to be applicable to all owners of flats in this complex
