99wheelchair.com Defective Product

1. I purchased the wheelchair (WC) online on 16-May-2012. The price of WC model FS950LBPQ was quoted, and still is quoted, as Rs 12,000 on their erstwhile website http://jeegarenterprises.net now renamed http://www.99wheelchair.com. However, sensing my urgent need, they charged me Rs 14,000. 2. I received the WC in damaged condition which I immediately informed them. However, their behavior on the phone was very disrespectful and after a lot of follow up they sent some parts even after fitting which the WC was going in only one direction. They advised me to get the WC repaired by a cycle mechanic or any other technician. We tried this for over four to five months and all technicians said that it had manufacturing defect. 3. After several discussions with them, they agreed to provide replacement. So I sent the defective WC back to their Mumbai address with great difficulty and expense of Rs 2,400. 4. However, upon receipt of the defective WC, they again started to make me wait saying they did not have stock of new WC. Then I finally agreed to accept the same defective WC after they assured me that they would repair the same and make it like new. Also, that if I find any defect in the same, they would not only send the new WC but also bear the cost of to-and fro courier cost. I accepted the repaired WC and brought it to my town at my expense of Rs 1,400. 5. However, the repaired WC had the same original defect. Upon several rounds of discussions, they again agreed to provide replacement with a new WC. So I again sent the WC to their Mumbai address at expense of Rs 1,500. Despite their written commitment, they did not agree to reimburse this courier expense but we agreed that they would send the new replacement WC at their own cost. 6. They have been delaying dispatching the replacement wheelchair for more than two months now by giving false promises each time. However, today they said they would not send the WC and we can approach court for settlement.

I am a handicapped 55 year old lady whose mobility depends on WC of particular dimensions which are rarely available. I suffer from multiple illnesses which further worsens my situation due to lack of a properly functional wheelchair. Since I live in a small town named Banswara in Rajasthan where WCs are not available, I depend on procuring WC from outside with help of my relatives. I have been using WC for over thirty years now. In this case, this particular wheelchair (Model FS950LBPQ), suited my need and I purchased it through distant transaction with help of my niece Dr. Tulika Mehta Agarwal. All this while, they keep saying the WC is not defective to defend their argument despite the fact I have been using WCs for over thirty years and no one can be better than me in judging the functional efficacy of WCs. I have incurred a total expense of Rs 19,300 (initial purchase cost plus multiple courier costs); mental agony and harassment due to disrespectful and insensitive behavior of these people with an old and handicapped lady; and physical discomfort due to lack of availability of WC despite having purchased one ten months ago.
