Sub: Sealing of the address of Avian, Holidays, on 11.11.2014 by Lake PS as per the direction of the President, District Consumer Disputes Redressal Forum, Barasat. ( Copy attached)

Ref:1. investigation under Lake PS (DD) Case No 29 dt 21.1.13 and seizure list dt. 1.2.2014.issued by Shri Sanjoy Roy,S I, Anti Cheating Section, Detective Department, Lal Bazar, Kolkata Copy attached.

Ref:2. Investigation under Lake P S U II case No 428 dt 28.11.12 and seizure list issued by Shri Sunil Kumar Mishra, S I, Lake PS on 12.3.13. Copy attached.

Ref 3. Our letter dt 10.11.14 addressed to Anti Cheating Section Police HQ. Lal Bazaar , Kol-1. and cc marked to Lake Thana Gariahat Road Kol-68

With reference to the above we are sorry to lodge our grievances for locking/sealing one room at our business centre on 11.11.14 for the following reasons:

1. The court had directed to seal the address of Avian Holidays but the room sealed no more belongs to Avian Holidays.

2.. From the earlier investigations mentioned above, the Thana officials were well aware that M/s Avian Holidays left our premises long back even without clearing our dues. A copy of our letter dt 1.11.12 received by the proprietor, Avion Holidays on 2.11.12 was shown to the investigating officers and attached for your ready reference.

3. During Sealing process, we strongly protested against sealing of the premises which are no more related to the case and will cause loss and harassment to other persons who are not connected in the case. We also produced all the relevant documents once again, though the matter was clearly known to THE Thana and they could have forwarded the investigation reports to the concerned court to avoid the harassment and loss to the unrelated people.

4. The intention of the court was to arrest and block the activities of the offender.and during investigation, we also provided the copy of trade licence of the offender which shows the address of their registered office and a copy of the same is attached for your ready reference.

5. Despite of all this the authorities were not getting convinced, we approached the SI, anti Cheating section of Lal Bazaar, who had also seen all our records earlier and investigated the case and after seeing the records, asked us to explain the matter once again to the concerned Thana officials who should apprise the court the correct facts of the case.

Apprehending the awkward situation, we would make our humble submissions vide our letter dt.10.11.14 addressed to O/C, Anti Cheating Section and cc marked to you whereby we tried to seek the advice as to what is expected from us to help the authorities in further investigations and how the unpleasant situation can be avoided. This letter was not received. We attach the same for your ready reference and would earnestly request you to direct the authorities to unlock the sealing and submit to the court their investigation report and facts of the case as seen by them.
