My mother has policy OG-13-1901-1801-00044418 for motor vehicle insurance. I filed claim on 11-Nov-2013 but the Insurer was not present and asked me to submit a signed blank form and filed the claim on 18-Nov-2013. Initially the surveyor refused claim stating there was delay. 1. Vitthal Sahakari Sakhar Kharkhana v/s Group Janta Insurance, Jan 2013, Mah State Con. Comm– Time limit for filing claim is directive in nature and not mandatory. “This commission has constantly held that giving intimation within specified period or within one month is not a ‘mandatory condition’, but it is ‘directory’ in nature and breach of this condition does not empower appellant insurance company to forfeit or foreclose the insurance claim required to be duly settled….” Thereafter they started giving various reasons. 1. Cost of repairing the damage as prepared in the claim estimate from tata motors authorized workshop. 2.Cost of mental torture Rs. 10,000/- 3. Direction to all insurance companies to discourage practice of obtaining blank signatures on forms. and to prominently display them on claim forms.
