Dear Sirs,
We had purchased the above Bajaj Air Cooler from M/s. Sai Ganesh Electronics, God Deo Naka, Bhayandar (E) vide their Bill No.910 dated 13-03-2009 for Rs.4100/- having a warranty of one year.
As the same started giving us trouble within few months of purchase, my wife (Mrs) Sonali P.Guru, in whose name the purchase was made, addressed a letter dated 24-03-2010 to Shri Shekhar Bajaj, CMD, Bajaj Electricals Ltd., 45/47, Veer Nariman Road, Fort, MUMBAI 400023, requesting to either refund the amount or replace the defective Cooler with a new one.
The Company did not care to reply to this letter and ostensibly carried out the servicing of the same and assured us that the problem would not recur and we may start using it again. Further, prior to this, we had already been charged twice by the Company for changing the parts during the warranty period of one year – once on 30-07-09 and again on 06-03-10.
A few months after this incident, around midnight, my wife noticed ‘SPARKS’ coming from the Cooler and using presence of mind, we switched off the same in time which saved not only the lives of my family members but also our house from engulfing in a major fire.
Thereafter on 10-07-2010, we addressed another letter to the Company requesting for refunding the amount of RS.4100/- immediately as the Cooler in questing had become a standing threat for our lives and it was a dangerous proposition to continue using the same.
I also personally met Mr.Pramod Khosla, Sr.General Manager & Head – Marketing Appliances BU, Bajaj Electricals Ltd. twice in this regard who assured me that the defective Cooler would be replaced with a new one shortly and would not have any complaints on account of the same.
However, I was astonished when instead of honouring the verbal commitment given by Mr.Khosla to the undersigned, the Company vide its letter dated 23-07-2010, refused to give a replacement and stated that only the defective part can be changed and no refund of amount would be made.
Thus the Company wanted us to risk our lives and use the same Air Cooler which would have certainly resulted in a disastrous situation for my family members and me.
We would therefore like to file a Complaint Hon’ble Consumer Court, Thane, for a monetary Compensation of Rs.4,00,000/- (Rupees Four Lacs) against Bajaj Electgricals Ltd.for having cheated on us and supplying us with a defective and sub-standard product which not only endangered our lives but also resulted in mental agony, tension and harassment for us.
In view of the above, we request you to place accept this Complaint against the Company in question and let us know further procedure to be followed in this regard.
