Country Club India Ltd – Misrepresentation during presentation

I was invited by telephone for a free holiday gift of 6 nights and 7 days. I attended the presentation at Hotel Aroma, Sector 22, Chandigarh on January 3, 2014. On misleading presentations/Misrepresentations, I was sold a 10 year membership by Country Club India. It was falsely represented that the Country Club has its own resorts globally including Europe. It was represented that the resorts all over the country in India are 4star/5star level. Later on inquiry, it was found that the company does not have any resort of its own in Europe and infact hardly any resorts outside India. The presentation was given stating that Country Club has resorts in India and internationally, however the website mentions more about Hotels than resorts. On telephonic clarification, Shri Girish and Shri Vijay Chaudhary tried to explain that they have tie-ups in India and abroad and not their own resorts. Further inquires revealed that most of the Hotels even in India, not to talk of abroad are not even four star and of very low quality. It was my pre-condition for taking membership that the undersigned would be entitled to use the Fitness Club of Country Club (including the Club in Sector 9, Chandigarh). However, the receipt received through e-mail mentions membership as “No Club”. Even an e-mail reply by Mr. Vijay is now denying any Club Membership, which is against what was represented by him while selling the membership. As originally agreed during the presentation, I had to pay 70,000 in two instalments of Rs. 35,000 each by cash. However, on the false pretexts, my Credit card was taken and swiped for Rs. 70,000 even though they took it only to check its details. To my surprise and shock, my account was debited for Rs 70,000 at once without my consent. I have not yet got the membership papers from the Head office of CCIL and believe that the contract has not yet concluded. I have not availed any facility of CCIL till now and was misled by their presentation. I have decided to seek back the amount of Rs. 70000 that was debited on my Credit Card. I have lost complete faith in Country Club and want m hard earned money back.

Seek back the wrongful payment made of Rs. 70,000.
