Datawind not refunding my money nor delivering the product

I Have pre-booked Ubislate 7(commercial version of Akaash tablets) in Dec 2011 and got the booking id as PMC1F8C from Datawind. After waiting for almost 4 months in May 2012 I emailed the Datawind team to know about the expected delivery of the product pre-booked by me. After 10 days I got their reply saying that deliveries has been started and if I pay in advance Rs 2999 for the product, I would get the product in July 2012. SO to get the product early I made the payment of stated amount through a demand draft number 810118 drawn on SBI on 7th June 2012. (My biggest mistake and I am regretting it every time I think about my hard-earned and saved money given to them so that I could get a device I actually can afford due to financial constraints). After asking them several times to provide confirmation of receipt of advance payment, they finally bothered to reply back on 9th August 2012 confirming that my Demand draft has been received against the early delivery of the Product and that I will receive my product in September 2012. Since then, Datwind has been playing email-email with me promising that I will get my product in October 2012 hen after the October has passed I have written them several emails asking them about the delivery but they didnt respond at all. Then, on 6th December 2012 I receivd an email from them offering me an updated version of product I have booked with them and a guaranteed delivery of the product within 10 days if I will make the payment through online.Since, I really wanted the product I paid the money (Rs 1,000 more) through online mode to get the upgraded version which Ubislate 7Ci (My biggest 2nd mistake because they again lured me and got more money from me on the promise of early delivery, you can see imagine my plight that how bad I want the product and I really worked hard to save that money so that I can get the device from the savings). After making the payment on 6th December 2012 I got the new booking id which is PM360D7 from them and a link through which I can access the Status of my order. After waiting for 20 days, I emailed them asking them about the delivery but they didn’t respond at all to my emails.

Finally on 31Dec 2012, I emailed them saying that I had enough and I want my money back. They replied me that my order has been dispatched and I will soon received my tracker no. Since the I am emailing them to either refund my money or provide me the tracker no. so that I can be sure that product has been dispatched (which i am pretty sure that they hasnt dispatched anything at all). Now, even after waiting for a whole year and paying them in advance for the product neither I am getting the delivery of the product nor they are refunding my money.I sincerely request you to please help me in this case to get my money back from the fraud company. Device is not yet delivered and amount not refunded.
