Falco Developers – delay in offering posession of Flat

Since you had not replied, I have tried to understand how exactly you have gone about demanding the enhanced EDC and have to come to following conclusion which I would believe are illegal and hence needs a review at your end. 1. Overcharging the EDC Rate The enhanced EDC fixed for Faridabad by HUDA for the year 2009 vide their circular no HUDA-CCF- Acctt-I-2011/20224 dated 14.7.2011 is Rs 232.84 lakhs per acre for Group Housing Projects. Further HUDA’s circular dated 23/05/2011 bearing no HUDA-CCF-I-Acctt–2011/17904 stipulated how the EDC rate for other years is to fixed. For the year 2006, HUDA stipulated that “the rates may be made applicable after reducing same 10% per year on compoundable basis” Considering the rate for 2009 is Rs 232.84 lakhs and applying the above principle ( 10% reduction on compoundable basis ), the EDC for the year 2006 should have been 169.74 lakhs per acre not 174.94 lakhs as is charged by you. Hence on this account you have overcharged 5 lakhs per acre. 2. Overcharging the EDC Amount. You have charged a total of Rs 246.60 per sqft (Initially Rs 125 and subsequently Rs 121.60) towards EDC. Calculating the EDC rate based on HUDA rate (calculated from 2009 rate and arriving at 2006 rate as per the guideline) and based on acreage of 49.018 acres the rate should have been Rs 222.67 per sq ft. You have thus charged Rs 23.93 extra per sq ft which for me translates to ( Flat area 1791 sqft) Rs 42324.48 as extra amount. All these calculations are based on 49.018 odd acres which may not be applicable as on date. Further I would like to know the basis for calculating the super built of area as 1791 sqft based on the carpet area. There seems to be certain anomaly. 3. Over Charging on a higher acreage. Your calculation seems to have been made on 49.018 acres which was actually the initial plot size. Subsequently you have hived off about 7 acres for KM Birla School and other activities which are not directly related to Savanna Group Housing. While the full amount to be paid to HUDA on account of EDC has been calculated on 49.018 and divided over the flat buyers, the seven acres you have hived off has not been set off. Thus in a way on a smaller plot size of 42 odd acres the full loading of EDC on 49.018 has been done, thus charging a much higher amount to the flat buyers. Most probably you have also charged K M Birla School with EDC charges there by charging twice on the 7 acre odd land which you have hived off and have retained same. While on the subject, may I remind you of the fact that when the flat was sold to me there was no mention of the K M Birla School and other activities in the brochure and other material , based on which I had booked my flat. Any subsequent changes to the plan need my consent which you are bound to obtain from me.
