Faulty Nokia N-95 Handset

I had purchased Nokia N-95 80 Gb handset from CROMA Juhu outlet, on 2nd August at 5 PM, same went faulty on the 7th August, taken to nokia care centre for checking, same was handed over to them for sending to their HO on 10th August to their service franchisee at Sakinaka,job sheet number 570504867/090810/16.
After several telephonic follow ups, no sign of replacement, since handset failed in just five days, I seek complete refund of the amount or a brand new handset, have sent various e-mails to their e-mail id as well.
They have today sent a used handset as a replacement which is old and not acceptable. Please help
