Festoon Lavender – builder fraud

I had taken a property at Festoon Lavender and a sale deed for 5.6 Lacs calculating to 20% of the Total Cost of the Flat including registration in Jan 2011. A Payment of INR 1 Lac was made in Jan 2011 and the remaining 4.6 Lacs in April 2011. However all my efforts to get a bank loan with Nationalised and private sector banks such as HDFC, ICICI, SBI, LIC etc has gone to vain as the property is in the nature of a pent house and does not have appropriate BBMP approvals and tax paid details as well as a B KHATA. Also there is no lift from the 3rd Floor of the Apartment to the Pent House in the balcony. We decided to do away with the property and informed your agent in October 2011 for a refund and after multiple negotiations, we got a partial refund on 1 Lac from Mr Basavaraj in Jan 2012. We also gave in writing to cancel the sale deed and agreement in Jan, 2012, however we have still got the refund of 4.6 Lacs from the builder. The builder has been quoting defunct reasons such as sales tax raid at his office, personal problems, looking at someone else to buy the property, etc. We need our money immediately , per se the agreement, any party can cancel the contract by giving in writing and its very clear in the agreement on the clause to pay 2% interest. The builder has been playing around with our cash and not available to talk to us half the time and has been buying time from the past 11 months.
