flipcart – replacement of Defective Parts

have brought the product Xolo X900 from flipcart on 29/12/2012 for Rs. 17500/- against invoice no. BLR20121200258856 with imei no. 911202500250576 and on 18th august 2013 suddenly it got shut down and further it is not wake up at all. I submitted the handset as per the discussion with customer care call centre toll free number executive to the jayanagar, bangalore pick up point on 21st August 2013 and received work order no. 310000092035. And on 1st week of September 2013 i got a call from Jayanagar pick up point saying my handset is ready for delivery. I collected it and surprisingly i find another complaint on the handset that left hand portion of the touch panel is not working or responding at all. Again i called up customer care number and they asked me to walk in to the service centre called F1 Services and Solutions Pvt Ltd near Hudson Circle, bangalore 560026 which is about 20km from my place. I visited them and they given your work order no. 310000113079 date. 23/09/2013 and informed that will get it rectified within 7 days and promised me that will call and inform in 1 week. No one called in 1 week and i tried to call service centre in the provided number, no one picks up the calls,both numbers are always busy. I visited service centre on 8th october 2013 and they informed me that parts are not received from xolo company and will get it within a week. again i visited them on 25th october 2013 and they are trying to taken further time. Then i shouted at them and by then they are saying parts are not at all available from xolo and they forwarded the case to xolo company, like me there are 100’s of cases pending. And he informed that company will decide about the issue by tomorrow that whether to replace the product or refund the money. Till now information about the same I thing they are simply playing by extending days. So i am thinking to register the complaint in consumer court to recover my money and compensation for trouble happens to me

, therefore pray that please grant relief as follows: a)They should pay the full invoice amount of Rs 17,500 b)they should pay me compensation of Rs 25,000 for causing losses of data, mental agony, harassment and inconvenience. c)Interest @ 18% pa on above amounts till the date of realisation of claims. TOTAL RELIEF: Rs. 42,500=00 + 18% interest
