Harina Builders Pvt. LTD – doesn’t have water, electricity and drainage system

We purchased 2 sites (44 & 45) bearing the Sy.No 58/2, situated at Chennahalli Village, Jalahobli, Bangalore North(Addl.) Taluk from Sujatha Reddy of Harina Builders Pvt. LTD. We have purchased the same on 21-10-2006. We had payed 24 lacs at the time of purchase. We had verified with the Bank (Syndicate Bank NR colony Bangalore) on the authenticity of the property and the bank approved the project and has provided us the loan of 17,50,000/- We were assured that everything is provided and the colony will be developed soon. As I was deputed to Delhi and my wife who has to take care of a mentally challenged child, was not able to visit the site often, so we had requested Mr. Raghavendra Reddy to build a house there in the site and he always took money from us and had produced the completion certificate which was provided to the Bank. As I had requested my nephew to visit the place as it is long time that we had not visited the place due to our personal problem with the child, we found out that there is no electricity, nor water connection and the drainage system. The colony is not at all developed and even the house built is a sheet construction to which not even plastering is done. We also found that the house is given on rent by the builder to some party and the builder is collecting rent. Even the land value is not gone up. We checked the builder to sell the property as we plan to buy a flat in Mangalore due to my son’s health issues. Builder is quoting less than the amount what we payed 8 yrs back. If we had purchased similar land some other place or in Mangalore, the appreciation would be much faster and it would have doubled and three times higher in these 8 yrs. we have lost all our hard earned money and we are now unable to even buy a flat of our own. I hereby request the consumer court to take action against Mrs. Sujatha Reddy and Raghavendra Reddy for cheating us in buying site, fooling us by telling, he has built a house and also trespassing as he has given the sheet house to someone on rent and collecting rent without our knowledge. I would also want you to take action against Syndicate Bank, NR colony branch for cheating and betraying the trust we had in the Bank. How can a Bank give loan without verifying the colony details. I would like the builder to take back the land for 50 lacs as this investment in any other place in Bangalore or Mangalore would have fetched me 50 lacs or more in 8 plus yrs. I also want the builder to compensate me for all the trauma and the pain myself and the family had to bear due to this property. Even the bank is equally responsible for all the mess. If at all they had verified every detail of the land before giving the loan, we would have been fooled and would not be paying penalty for housing loan for so long years. We want the builder to compensate for all the loses we had from the last 8.5 yrs. We are neither able to sell the property nor we can stay there as the colony doesn’t have water, electricity and drainage system. would like the builder to take back the land for 50 lacs as this investment in any other place in Bangalore or Mangalore would have fetched me 50 lacs or more in 8 plus yrs. I also want the builder to compensate me for all the trauma and the pain myself and the family had to bear due to this property. Even the bank is equally responsible for all the mess. We are still paying the housing loan and penalty for taking the loan. Bank should repay all the penalty and waive off the loan as the land is not the worth 15lac even after 8.5yrs after our purchase. We had paid 24lacs in 2006.
