I hold a savings bank account at HDFC Bank, Sector 62, Noida and my bank account no. is 03941050071736. On 03/09/2012 at around 6:45 P.M, I tried to withdraw cash from a Deutsche Bank ATM from my ATM cum Debit Card (Card No. 4663 0301 0349 1981) located at Bishanpura, Sector 58, Noida. As the Machine gave me a message that the transaction was not possible i left the ATM. At 6:51:26 P.M I received a text message from HDFC Bank that Rs. 1,000 has been withdrawn from my Bank Account, again at 6:52:24 P.M I received another text message stating Rs. 9,000 has been withdrawn from my Bank Account. My Card was not stolen. I would like to bring attention to you that the ATM Machine was of Card Swipe nature, i.e. the machines that do not take cards inside during the transaction process. These offer single transaction for a single swipe and for further transaction the card has to be inserted again along with the PIN Number. Due to this nature of the machine it is not possible do to multiple transactions without the Card and the PIN. As my card was not stolen, the transaction must have been processed due to some technical error or through a duplicate card. After these text messages, I contacted HDFC Bank phone banking service at 011 61606161 to find out what has happened. The executive kept me on hold for sometime and informed me that, cash has been withdrawn from my account and it is possible that the card might have been duplicated and there is a need to block my card. On my confirmation the Debit cum ATM Card was blocked. Further a Complaint was filed by HDFC Bank in this regard and a complaint number was given to me i.e. MUMC0912020487. On 11th September 2012, I got a response from HDFC Bank in which the representative informed me that they have confirmed with Deutsche Bank and it was a clear transaction and they cannot do anything for this case. On filing a report with the nearest Police Station in Noida, their response was that the Police cannot help on this matter and the Bank needs to be consulted for the same. On a personal meeting with the Branch Manager of HDFC Bank, sector 62, Noida no remedy was provided in this regard.
As I am not aware of the reasons for this case, I held HDFC Bank Ltd. responsible for the loss of money as it was deposited in my Bank account and it is the responsibility of the Bank to keep custody of my money and to prevent the withdrawal to anyone other than me. I demand the following: 1. Refund of Rs. 10,000 that was withdrawn through unauthorized means 2.The ECS Return charges of Rs. 295.15 3.Interest payable by State Bank of India for an ordinary Savings Bank Account holder from the date of loss (3rd September 2012) to the date of repayment by HDFC Bank Ltd. to me. 4.The amount of additional credit, that I could have availed if the repayment of EMI of my personal loan on 5th September 2012 was done on the due date, which has been lost by me due to the fall in the Credit Score (if any, as per CIBIL Score Report).
