Sub: Failure to deliver car in committed date and forcing to pay more / cancel the order. I booked a Hyundai i20 Sports Diesel, Color: Ember Grey on 23Dec2013 with DSC Hyundai,Chennai by paying an advance on 10000 rupees. The booking was taken by Purushoth.R and his manager Victor. DSC Hyundai ensured the model and color is available and committed to deliver the car before 31Dec3013 with the cash discounts and spares parts commitment made. Total cost on road quoted was 793281 lakhs, I availed car loan of 4.4 Lakhs with Sundram finance which was approved on 26Dec2013 to DSC Hyundai. After the loan is cleared Purushoth.R -DSC Hyundai ensured the car will be available by 30Dec2013 when I enquired him. On 30Dec2013 when I enquired again Purushoth.R-DSC Hyundai said the color is not available and refused to take the balance payment and said he will come and collect in a day after he checks the availability status; but nobody turned up. On 1Jan2014 when I enquired again they said they will get back and did not turn up. On 7Jan2014 when i walked to the showroom the manager Victor DSC Hyundai argued the stock was available when the booking was made but it was not available when DSC punched with manufacturer and he could not get the car and it was not his fault and also said I have to pay 23000 rupees extra to get the ordered model and color for which i refused that it was a failure in commitment and DSC is responsible in getting me the car i order. Victor-DSC Hyundai in a lethargically said if you don’t want cancel the order and made me frustrated. I walked off DSC Hyundai showroom.
I want the car for the committed price when booking the car and DSC to pay my 1st month EMI Rs.97771 as they accepted Loan from finance company and failed to deliver the car.
