ICICI Bank – Negligence of staff, cheque dishonored

I am an esteemed customer of ICICI Bank for more than 11 years having Savings Bank A/c No. 000301506316 and linked Trading A/c No. 085301503626. I had a pre-qualified offer of Home Loan for Rs.31 lakhs. As I am re-constructing my house, I had applied for the same online during end of May 2014. Telephonic & personal verifications were done by the ICICI Bank and Mr. Parth Kosambia, Business Development Executive, ICICI Bank, Mobile No. 9998014xxx collected the required documents from my residence and a signed blank cheque towards processing fee. On June 17, 2014 I was issued an Offer letter for Loan facility vide Application no. 7779798529 (Franchisee Code: BANK BAZAAR WL) for loan of Rs.20 lakhs (copy attached). Thereafter, I got a call from Mr. Parth that there is some query and he will be visiting my house with his Manager. Ultimately after repeated reminders he came to my house after almost 10 days alongwith Mr. Tanuj Dani, Branch Sales Manager, Mobile No.82380497xxx. The query was settled and Mr. Dani told me that everything is clear and loan will be disbursed shortly. He also told me to keep balance in my account for presenting the cheque towards processing fee. I asked him whether I will be given an alert before presenting the cheque to which he said that I will be alerted 2-3 days in advance for the same. On 7.7.14 @ 1830 hrs. I got a call from Mr. Parth (verifiable from my mobile data) that my cheque towards processing fee will be presented on 8.7.14 or 9.7.14. Just after 15-20 minutes I received a message from ICICI Bank that my cheque has been dishonoured due to insufficient funds. I was shocked and immediately contacted Mr. Parth, who also felt shocked and told me that he is rushing towards bank for checking how it has happened. Later I checked my balance and observed that an amount of only Rs.18.44 was short for the required amount of Rs.11,798/-. Also at that time my linked account had a balance of more than Rs.3,000/- and holding of around Rs.4 lakhs (verifiable data). In these days of technological development, alerts for petty transactions are issued to a customer. Had I been alerted timely, it was a matter of minutes for me to transfer funds from my linked account. Also, for so many months, I have been transferring funds online to my builder “Shree Shreenathji Developers” at different intervals amounting to lakhs of rupees and it was not hard for me to maintain balance of only Rs.12,0000/-. It can be verified from my account that no such negative transaction has been there for so many years due to my fault. Also, an amount of Rs.393.26 was deducted from my account towards RTN CH. On 9.7.14, I received an SMS from BnkBzr stating “Dear Sunil Bhikkilal Jain, Your ICICI Bank HL is approved. SMS “DISB” to 9223172356 if you need help with disbursal !. I replied to it but no response was there. On 10.7.14, I observed that pre-qualified offer of Home Loan to me has been raised from Rs.31 lakhs to Rs.41 lakhs (!).

i) Suitable penalty should be imposed upon the responsible staff handling my case for their negligence. ii) I should be compensated suitably for the torture me & my family have gone through mentally, physically, financially during the period and due to which my house construction is also obstructed. Or iii) Original amount of loan of Rs.20 lakhs offered to me should be sanctioned.
