Kaunsa.com – Non-refund of money

Sir, I Pradeep Kuril, R/o CMRA 10, Opp:PNB Atm, Mundamveli road, Mundamveli, Kochi, Kerala–682507 had placed an purchase order for a mobile phone twice and both the times the product was not delivered and the amount paid by me is not being refunded. www.kaunsa.com is a Noida based e-commerce firm owned by Mr Ashish Paliwal, registered in the name of Pooja Pandit. It sells products online all over the country. This firm is registered under the address C/o Mify Solutions Pvt. Ltd, 204 – 2nd Floor, Singhal Tower, Near Labour Chowk, Sector 58, Noida, Uttar Pradesh–201301. 1. I had placed order for a mobile on kaunsa.com order id being KA/136260/IBOGT for which I paid the requisite amount 5607.00 rupees through SBI net banking on 18 Jun 13. The delivery date promised to me was 7 to 10 days but when I inquired the status on 02 Jul 13 i.e., after 14 days as there was no communication from the opposite party, I was told by their rep that the product booked by me will not be delivered as the price of it is increased. I protested and asked them to cancel the order and refund my money for which their rep said refund is not possible instead issued a cash voucher code equal to amount paid by me. Even then I tried to get that voucher cancelled by sending emails and get refund and spoke to their five reps (Rohit, Vijay, Neha, Nisha, Kaushal) trying to get back my money and every time I was told to send an email but nothing progressed from their side. Meanwhile I checked if the voucher code issued to me is genuine or not, to my shock I could not login into my user account created in their website. It took almost 20 days for them to reset my shopping account meanwhile I sent many emails raising all these issues but no one even bothered to respond. Sensing that I’ll not get neither mobile nor my money I placed order for mobile again, costing 9965.00 (order id KA/136260/YBCNUEJL) on 30 Aug 13 using the voucher code plus 4358.00 rupees more. I was assured by web site rep that product will be delivered within stipulated time period and fault occurred before will not be repeated this time. This time again there was no communication from the opposite party regarding status of my order after I paid money. When I enquired on 14 Sep 13, the opposite party denied supplying of my order saying that they have no stocks of the demanded mobile. This time I sent the opposite party an email to process for refund clearly intimating them that I will not accept any vouchers. Since then I had called many time on the opposite party phone number and also raised many complaints on their web site but could not get refund of my money. 2. Though after intial denial for many days, the opposite party has updated the status of my product as to be refund on 26 Sep 13 since then I had been continuously calling the opposite party’s phone number but they are avoiding my phone call and also not responding my emails.
