Subject- Marriage ceremony CD not delivered after all payment

Dear Sir,
I got marriage on 17 feb 2009 and during marriage functions, the marwah lab civil line roorkee was fixed for capturing the Audio-vedio from 16 feb 2009(night function) and 17 feb 2009 marriage function at Roorkee.
The photograph captured the entire programme on 16-17 feb successfully and handover us the complete hard bound album and CD only of 17 feb 2009 programme, but till date he has not delivered the marriage function captured on 16 feb 2009 at night.
We made request him around 10 times by telephonically and personally visit and wait for 4 months to till date but still he is not giving us our complete work. In the mean time we paid all the payment to him.
Now please advise what i can do to get our complete work.
Or please advise a legal action that can be taken against him.
