Dear Sirs , I have purchased Micromax Mobile Phone Model no Q80 which comes with EZMAIL push mail service as inbuilt feature. However ,the service is not activated for my hanset from day one and the company has washed off its hands by informing me that the service is not available for the handset and that the same is not operational now. The mobile phone minus the feature is an ordinary mobile not worth the price I paid for the same. The company has prorata/proportionately recovered the price of the said PUSH MAIL service from me. As I have contributed to the price of the said service the company has to provide me the service or proportionaltely refund the purchase amount. Further since the company has sold the handset with promise of the above said pushmail feature, it is the duty of the company to keep it operational.Further Opera Mini 4 ,bloomberg UTV mobile , etc which are inbuilt features are not working. The company by not prividing and/or giving the services promised is indulging in unfair and deceptive trade practise . The company intially sent two lined replies but there after has not cared to reply to any of my letters or activate the service for my handset or resolve the issue. The company has with the said PUSHMAIL service lured me( thousands like me) to purchase the product, which otherwise I would not have done. The company has abused its dominant position as the Company is fully aware that the customer has limited resources and cannot reach or taken on it. The company has profited from the same.The act of the Company is against the estabilshed principles and practise of fair trade and in breach of code of conduct towards the consumers.
In view of the what is said above ,it is humbly prayed that an Order be passed against the company directing it, to provide the said promised PUSHMAIL feature/service with continous and prompt working or in alternative the company be directed , to take back the hanset and refund the purchase price and expenses incurred by me or to end the matter in good faith to issue me a credit note for Rs7000/- , which amount will be adjusted towards the price of another model of the company. I also humbly request yourselves to warn the company to desist/ restrain itself from such trade practice/s (of not providing what is promised).
