I have booked flat in Aug 2009. Possession date on agreement is Dec 2010. But still I didn’t get possession of my flat. Builder has stopped working from last around 2 years. He is saying he has no money for construction though he has taken 85% of flat cost from all flat owners.

Because of no possession of my flat, I was forced to take new flat due to which I have now loan of 37 Lac on new flat.

Possession of flat Or builder should pay EMI of my loan which I was forced to take as this builder has not given me my flat. Or builder should pay me the amount of my flat with current market rate in that locality.
