Nokia India – dealer refuse to warranty on exchanged phone

I’d submitted my under warranty mobile C6-01 (worth Rs. 16500) for repairs to authorized nokia care center in Thane in the month of July 2013. Post technical evaluation I was informed that the same is beyond repair and will be getting the same replaced with a Lumia-800. After few days I was asked to collect the replaced handset and on examining the same it was found that the same was a refurbished and I refused to accept the same. On protest the same was changed with another handset after few days which was accepted. However on inquiring for the warranty on the replaced handset I was informed that the 3 months balance warranty of previous hand set would be carried over to the new hand set. I accepted the handset under protest and filed a complaint. Since this is a new handset the company is liable to provide fresh warranty with provision to extend the same given the high cost of investment. Despite mails and followups the company has refused to do so, even after threatening to file a consumer complaint. Since this is a totally new piece I feel my claim of comprehensive warrant is justified and legal.

Since the replaced hand set is completely new I need a comprehensive warranty with provision to extend the same by payment of fees as per a new handset purchase. As the cost of investment is very high and if the handset develops any problems I will not be in a position to even get minor complaints attended as it is out of warranty as per companies statement.
