I had bought a flat in Omaxe, Omaxe Hills, Faridabad project in 2005. However Omaxe did not start construction of the flat until 2010 due to unknown reasons. Finally in April 2013, I received a letter from them offering me possession of my flat on payment of enhanced dues, which were not agreed at the time of allotment of Flat. I had no option but to make this payment as Omaxe told me that I will not be given possession of the flat unless I make this payment. However after making all the payments as per the Omaxe demand, Omaxe still did not offer me possession of my flat. After repeated follow ups, they asked me to submit an affidavit requesting Omaxe to offer me temporary possession of the flat only for Fitout purposes. The affidavit states that I will not use this flat for residential purposes until flat is registered in my name. It also states that Omaxe will offer me registration of Flat in only after 6 months. It also states that I will be liable to pay all the maintenance charges as applicable and would not ask for any delay possession penalty. I have informed Omaxe that I will not sign and submit this affidavit. Omaxe is now threatening me that it will not offer me possession of my flat until I submit this affidavit.

1. I need your help to get me immediate possession of my flat. 2. Omaxe should pay me interest and delay posession penalty for delay in handing over the flat to me. 3. All extra charges not agreed at the time of signing of agreement should be refunded.
