Our company possesses a Private Car Package Policy – Zone A, got issued by DO 18, Oriental Insurance Co. Ltd. New Delhi, respecting our Maruti Eeco 5 Str with AC+Htr(M),Model 2012, Registered No. DL09C AB 7135. We sent the vehicle to Carnation Auto, Sector 18, Gurgaon, an authorized workshop of Oriental Insurance Co. Ltd,on 12 Nov 13, for getting it repaired. Carnation Auto arranged survey of the vehicle. Mr Anil, the surveyor of the vehicle, advised us to fill a particular form,for claiming multiple damages occurred to the vehicle, on the different occasions/dates. After a few days from receipt of the said form, duly filled and signed, he told that we would get claim of the last damage only as we had not sent the vehicle for repairs, within 24 hours of the each accident. After that, we complained the matter to Mr. Rajender Kumar, Divisional Manager, DO 18, Oriental Insurance Co. Ltd., New Delhi, on phone No. 011-25554017. He intimated that we can get one insurance claim at a time. If we want to claim all the damages, we have to send the vehicle to the workshop several times, for getting all the said claims. Sir, sending the vehicle several times, for getting multiple claims, is not only illegal but impractical also. Thereafter, we complained the matter to The Chief Manager, Customer Service Department, Oriental Insurance Co. Ltd. Davendra Kumar, Dy. Manager, SVC RO – 1, in response, rejected our disputed claims on the same grounds as pointed by Mr. Rajender Kumar, Divisional Manager, DO 18, Oriental Insurance Co. Ltd., New Delhi. The following facts clearly support our plea for claiming all the disputed damages: (i) Sir, nowhere in the policy has been mentioned that we have to send the vehicle for repairs, within 24 hours of each accident. You would appreciate that it makes no difference either the vehicle is sent for repairs within 24 hours of each accident or after a few days from the various accidents. (ii) As the whole vehicle is covered under the insurance cover, claims for all the damages, irrespective of their occurrence/repairs, should be paid, without any condition. There denial by the Oriental Insurance Co. Ltd is absolutely illogical/illegal. (iii) There was a break in the insurance cover for a few days (from 11 to 18 Feb 13) hence a pre-insurance Inspection was conducted by the Oriental Insurance Co. Ltd. A sum of Rs 7,000/- was then charged extra also, for a few trivial damages like a few scratches and a dent. Declaration given by us, in the Inspection Report, clearly specifies that the damages mentioned in the Pre-Insurance Report (copy enclosed) are not covered under the insurance and would not be claimed. In other words, all the future damages ie other than those mentioned in the said Inspection Report, are subject to claim. It is hereby emphasized that all the claims in dispute pertain to the damages occurred to the vehicle after commencement of the current insurance policy by the Oriental Insurance Co. Ltd
In view of the facts explained in the complaint, s, you are earnestly requested to issue necessary directions to the said erring Insurance Company, for payment of our all disputed claims.
