1. That, On February 5th, 2013 the Complainant had purchased a one ton split 4 star air conditioner of the Opposite Party’s company from Rahul Electronics which is the authorized dealer situated at Dahisar, Mumbai by making the payment for Rs 28,600/- which also includes the installation charges of the same. Attached is a copy of the receipt as Exhibit A. 2. That, after the purchase of the product the Complainant during the normal course of usage one night the cooling not being proper, inquired about it in the morning and upon observation found that the outdoor unit of the same had a physical damage due to rat chewing and he immediately informed the executives about the issue and requested them to replace the outdoor unit but to his surprise, no replacement had been done till date though he was ready to pay the charges for the same. As a result of which, he had to keep the air conditioner on functioning mode in order to avoid further damage through rats. 3. That, the Complainant also had to pay high electricity charges. A copy of the electricity bills is attached as Exhibit B. On repeated request to the company to replace the defective part, no response had been received from your side. Each time when he contacted the executives he was told that the part was not available with the company. 4. That, the Complainant had also paid in advance an amount for Rs 350/- but still the defective part had not been replaced. A copy of the advance payment receipt is attached as Exhibit D 5. That, the Complainant tried to resolve the issue himself and even sent a letter to the Opposite Party, dated November 7, 2013, in pursuit of the same. A copy of the letter and its courier receipt is attached as Exhibit C.

1. Refund/replace/deliver etc. Rs. 28,600/- 2. Refund legal charges Rs. 10,000/- 3. Refund amount towards mental distress and agony Rs. 50,000/- 4. Provide with records of miscellaneous charges.As attached in Exhibit B & D. Rs. 3432/- 5. Ask Opponents to apologies for the deficiency in services carried out by them 6. Pass any such orders and reliefs deemed fit and proper by this Hon’ble Forum in view of the facts and circumstances of this case. TOTAL Rs. 92,032/-
