01. We have decided to purchase house during Feb-2003. 02. As per my requirement Mr. C. S.Rao has sold his own house & arrange bank finance from State Bank of Saurashtra (now merged with SBI), he did all the formalities including preparation of sale deed & other legal procedures, we just paid him the amount which was required to fulfill the requirements as asked by him. 03. We got a call from him & based on that we reached to State Bank of Saurashtra & as asked by him & Branch manager Mr. A. C. Palan we filled up a loan application & submitted on same date, it is on 15th Feb’2003. 04. On 11th Mar’2003 loan got sanctioned by SBS for Rs.250000.00. 05. As on date we have not receive disbursement voucher copy. 06. As on date we don’t know how much amount paid by SBS to Mr. C.S. Rao. 07. We don’t have any signed document for disbursement voucher. 08. All activity done by Mr.C.S.Rao & he/ Bank has not provided any documents to us & through letter dated 11th Mar’11 we have been informed by bank that your loan got sanctioned & bank is having all the original documents with them & now you can shift to the said house/ flat no. C-14, Amrapali Co-Op Hsg. Soc., Ankleshwar. 09. From the day loan sanctioned by Bank we were paying regular installments to the bank till the time of dispute. 10. Dispute arrived on 12th Sep’2005, when Vijaya Bank have sealed the house along with all the things those were in side the house like cloths, furniture, electrical things etc. & taken charge of the house forcefully, at the time Vijaya Bank sealing our house we called State Bank of Saurashtra & came to know that Branch Manager is out of Town so that bank couldn’t help in this. Than we requested to Vijaya bank during visit to their Ankleswar branch on same day & after our written request they released our furniture, cloths etc..& again they taken charge of house & sealed. Further during discussion with Vijaya Bank on 12th Sep’2005 we have been informed by them that there is already a housing loan on A/c of Mr. C. S. Rao only & as he is not paying installments so they sealed the house. 11. On 14th Sep’2005, we given written information to SBS, Ankleswar that the property sealed by Vijaya Bank & as I don’t have any document so pls. provide the same. 12. We got few of the documents from SBS after almost 15 days from my written letter dated 14th Sep’2005. 13. When we analyze the episode we realized that we have been cheated by Mr. C. S. Rao & Mr. A. C. Palan (Branch Manager, SBS) by a mutual fraud by them. 14. Based on documents recd. From SBS we registered a criminal case at Ankleshwar court during Nov’2005 against Mr. C. S. Rao & Mr. A. C. Palan. 15. We asked supporting documents from Vijaya Bank from 28th Dec’2007 but they refused. After that we asked the same through RTI on dated 9th Jan’2008 by paying the necessary charges through DD but on 30th Jan’11 they also refused & informed that they can’t provide such details of their
i want sbi to withdraw case against me with no pressure in future also & refund of amount which i paid against installments of home loan. i also like to take the issues with vijaya bank who sealed the house & later sold to some one else without information to us..we would like to know at what amount they sold the flat & if it is greater than the dues then they are also requested to pay the balance amount to me so that i can pay to sbi also & the remain amount i can considered as reimbursement of mental harassment to me
