Complaint under section 12 of the Consumer Protection Act, 1986. Respectfully Showeth:- 1) That the petitioner on 28th June, 2011 engaged the services of the opposite party/respondent who is engaged as BUILDER Shipra Estate Limited & Jai Krishna Developers Private Limited, Shipra Mall Plot 09, Vaibhav Khand, Indirapuram, Ghaziabad, U.P. – 201011 to develop and handed over Housing Society named Shipra Krishna Srishti which contains of the FLAT No : “HAR-1004”, Indirapuram to be handover for possession to the petitioner “THE ALLOTEE” Mrs. KAPILA RAWAT MIYAN by 31st Jan 2012 as per buyer-seller agreement with 6 months grace period. 5) As we can see above on enquiry made by the petitioner with the BUILDER regarding the possession of FLAT to her, the builder has given a new date and as per the current progress of the this Housing Society it look like BUILDER is least serious and interested to handover the FLATS to buyer like me. I have CC this Legal notice copy to few more FLAT Allotted like me for their reference. 6) That when the petitioner realized the physical construction state of FLATs it is highly impossible to provide a newly committed possession date i.e. November or December 2013 by BUILDER on 10th July 2013 by written communication through post.

It is, therefore, prayed that the present complaint may kindly be allowed & passing following orders, directions in favor of the petitioner and against the opposite party in the interest of justice and fair play. I. Direct the Builder to be pay an immediate lump sum compensation amounting to Rs. 300,000/- to the complainant on account of delay, inconvenience, mental agony harassment to petitioner II. Direct the Builder to be pay an immediate monthly compensation amounting to Rs. 20,000/- per month as rent till the final possession of the FLAT by the BUILDER in future. III. Any other relief which this learned forum deems fit in the facts and circumstances may also be given to the petitioner.
