Sony Ion phone – still under 1 year warranty period phone replacing by dealer

After struggling with a new Sony Ion phone for 11 months (still under 1 year warranty period), the company has offered to give a new model but without warranty! The second option they have offered is to buy a higher model by paying the remaining amount. But why should a consumer choose to buy a new phone from this company? Why not refund or give a new phone at the same MRP at which the model was bought with a warranty?

Full refund with compensation for making so many trips to the service centre and facing staff’s misbehaviour. Or at least, a new phone of the same price at which the old model was purchased along with compensation for running around to the service centre.
