spice online retail pvt – sent the bad product not sending the new one

Dear Sir, i have purchase a mobile from saholic a online mobile retailer and a venture of spice online retail pvt ltd.on 10th of dec,2013 & i have received it on 13th of dec,2013 the product was not ok i called up saholic the said go to service centre the y will update the software in ten minutes. ihave visited the service centre and they hold my mobile till 18th and received a DOA certificate for exchange and i had been told not to open the packet.then i sent it to saholic they received it on 21st dec,2013 since then they told me that within 10 days you will receive the exchange product.today is 30th and still i am trying to talk to them and they are saying wait….i have received a call from spice head quarter on 30.12.13 that you didn’t send us the DOA certificate…then i told them it was inside the packet and i was advise not to open it…initially the regularly telling me that it is in process i mean if it was not inside why you took 10 days in finding out the same.

i want my cash refund with penalty on them so that they will learn the basics of business
