Tata Motor finance – unreasonable and unfair amount from us

Sir, I’m Shireesha from hyderabad and my father M.gopal reddy who have purchased the tata safari LX on 15/02/2007 from concorde motors by taking finance from tata motors finance ltd and the car loan finance amount is rs.600000 and finance charges rs.192,000 and total contract value is rs. 792,000 with rs.13200 as monthly installment for total 60 months i.e for 5 years. The vehicle bearing registration no.AP11A6652 and the tata motor finance ltd loan cum hypothecation agreement no. 5000064792. My father have paid the car installments regularly till march 2009 but after that couldn’t pay the installments due to severe financial crisis. On 10/may/2010 TMFL has repossessed the car and resold to third party without any notice given to us. Yesterday i.e. on 22/july/2013 we got a legal notice from tata motors finance limited stating that we got to pay sum of Rs.6,30,176/- within 7 days and in case of failing application will be filed before the court for execution of the said amount. Till march 2009 my father have paid 3,30,000/- for against rs. 6,000,00/- and moreover they have repossessed the car resold to third party and the loan maturity time is 11/01/2012. Today after 3 years i got the legal notice to pay 6,30,176/- but on what basis should i repay?

The accessories in the tata safari LX dicor done by father worth costs more than 50,000/- and the ex-showroom price is 7,12,993/- excluding life tax and road tax etc. we didn’t got any intimation of the vehicle sale after repossession of the car and at what price they sold etc? simply after 3 years i received the said legal notice from TMFL.

We want to file case against the TMFL at consumer court and get relief from the TMFL for claiming unreasonable and unfair amount from us. please try to help us by guiding us how to protect our consumer rights.
