Yamaha – warantty period part is not available in the stock

Technical Problem occurred after 3 months of purchasing, there was problem in shifting of gears and as per mechanic push up roll was damaged which is under warranty.I was told by the service center that part is not available in the stock and it will take 15 days to receive the part.It has more than one month since I lodged the complaint and my bike is still standing from last one month. Date of Purchase: 30.08.2013 Problem occurred: FEB 2014 Complaint Lodged: 18.03.2014 Complaint No: IC-10799-F1P5

Can company take my bike back so that i can purchase a more trusted brand?
