HTC Desire – Mobile Hanging & Booting problem

1. That I purchased one HTC Desire 600C (Black, with dual SIM), hereinafter called the ‘Device’, bearing IEMI no.357211050128927 from M/s WS Retail Services (P) Limited vide Tax Invoice no. BLR_WFLD20131000622905 dated 29.10.2013 for Rs. 27,499.00. Copy of Bill is annexed herewith and marked as Annexure-A. 2. That flashy full page advertisements canvassing features, quality, reliability and after sales service of HTC mobile phones were volitional in preferring purchase of same over competition. 3. That the Device developed hanging while booting problem within warranty period. It was rendered dysfunctional sometime in May 2014. It is pertinent to note herein that, the device started hanging, in a little over six months of purchase. 4. That the Device was repaired by HTC authorized service centre at Ansal PlazaNew Delhi-110049 vide HTC repair report Q7S14051500016. Copy of said Repair Report is annexed herewith and marked as Annexure-B. 5. That albeit problem of hanging during the boot period was corrected, but the response time of the Device increased and developed infrequent hanging during idling. 6. That due to paucity of time arising out of my professional commitments, I continued using the Device by applying quick fix of rebooting it after keeping the battery out of the phone for a trice. 7. That the device developed repeat problem of hanging during booting period in April 2015 and was rendered dysfunctional. 8. That device has been received for repair by the HTC authorized service centre at Ansal Plaza New Delhi-110049 vide service report Q7S1504100036 dtd.10.04.2015. Copy of said Service Report is annexed herewith and marked as Annexure-C. 9. That a continued silence on status of the Device is being maintained by the authorized service centre, despite follow up calls with ticket number 15INA150015293 dtd.20.04.2015 and 15INCW17ENA000681 dtd.21.04.2015. 10. That in base of supra facts it is alleged that the Device is defective and suffers from design flaw and slipshod quality not fit for the Indian operating conditions. 11. That I sent a written notice dated 22nd April 2015 to HTC, which was followed by stoic silence, till a mail was received on May 13th 2015 thereby acknowledging receipt of notice and assuring resolution of issues detailed therein. Annexure-D 12. That a subsequent call was received on the evening of May 19th 2015 by my consort on my mobile number 9312628052 from Mr.Piyush, who identified himself as the legal representative of HTC and expressed willingness to understand the issue for an amicable resolution. He was humbly requested to call next day before noon for a successful discussion on the matter. 13. That consequent call was received from Mr.Piyush on forenoon of Friday 22nd May 2015 to resolve the issue in wake of notice dated 22nd April 2015. 14. That a verbal offer to replace the impugned handset with a new one was made by Mr.Piyush during the supra telephonic conversation.
