Sir, i had purchased a dell laptop on 18 feb 2011 from dell official Noida store. one year complete cover and accidental damage insurance was provided with same. before the expiration of warranty i renewed it for another one year by paying the charges to dell india. during the warranty period my laptop accidentally fell down from my terrace and got physically damaged and company was informed for the same on 09-09-2012. i made several attempts but company didn’t pay any need against the lawful grievances.lastly on 29-09-2012 they denied stating damage was due to your negligence we will not repair. sir accidents occurs due to one sheer negligence only, no one do by their own choice. they were in mood to listen to my grievances and unlawfully neglected providing services. though according to their contract they have mentioned accidental damages due to drops falls spills are covered. i have attached the company contract please pay attention at the underlined.
this unlawful practice resulted in loss of 51000 rupees plus 8000 rupees paid for extending warranty of the laptop. i’ve already registered a case at district consumer forum case no 25/2012 but it is pending till date due to unavailability of honorable judge or members. please help me in redress of my case. i had also appealed in national lok adalat held on 6/12/2014 at my district. and company was informed in due time. still company paid no interest and didn’t turn up for the hearing. they have cheated a Indian consumer by stating false promises in their contract.
